Terms & Conditions

Last updated: October 25, 2026

Acceptance of Terms

These Terms & Conditions (“Terms”) govern your use of the Climber Code websites, climbercode.dev and climbercode.com (together, the “website”), and any services we provide. By accessing our website or engaging us for a project, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Our Services

Climber Code provides software development and consulting services, including SaaS and product engineering, AI and automation, e-commerce and digital experiences (including Shopify development), custom business software, and systems integration.

The specific scope, timeline, deliverables, and fees for any engagement are agreed separately in a written proposal or statement of work signed by both parties, which takes precedence over these general Terms where the two conflict.

Discovery Calls, Proposals & Estimates

Discovery calls and initial consultations are provided free of charge and without obligation. Any ideas, timelines, or estimates discussed before a signed agreement are for guidance only and do not form a binding offer.

Proposals and estimates are based on the information available at the time. If requirements change, we will discuss the impact on scope, timeline, and cost before proceeding.

Use of This Website

You agree to use our website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of, this website by any third party. You may not attempt to gain unauthorised access to any part of our website or systems, or submit false, misleading, or malicious information through our forms.

The content on our website is provided for general information only. While we aim to keep it accurate and up to date, we do not guarantee that it is complete or free of errors, and it does not constitute professional advice for your specific situation.

Third-Party Platforms & Links

Our work may rely on third-party platforms and services, such as Shopify, cloud hosting providers, payment providers, AI model providers, and other APIs. These services are governed by their own terms, pricing, and availability, and we are not responsible for changes, outages, or limitations introduced by those providers.

Our website may contain links to third-party websites. We are not responsible for the content or practices of those websites.

AI & Automation Outputs

AI-powered features can produce incorrect or incomplete results. Where we build AI or automation solutions, we design appropriate validation and human review into the workflow, but you remain responsible for reviewing AI-generated outputs before relying on them for important business decisions.

Intellectual Property

Unless otherwise agreed in a signed statement of work, all content on this website, including text, graphics, logos, and code, is the property of Climber Code or is used under licence, and may not be copied or reused without permission. Some photographs on this website are used under the Unsplash License.

Ownership of work product delivered under a client engagement is governed by the terms of that project's agreement.

Fees & Payment

Fees, invoicing schedules, and payment terms for a project are set out in the applicable proposal or statement of work. Unless otherwise agreed, invoices are due within 15 days of receipt, and late payments may result in a pause of ongoing work.

Confidentiality

We treat client information, project details, and materials shared with us as confidential, and we expect the same in return regarding any of our proprietary tools, processes, or materials. Confidentiality obligations survive the end of an engagement.

Warranties & Limitation of Liability

We perform our services with reasonable skill and care. Except as expressly agreed in a signed statement of work, our services and website are provided “as is,” and to the fullest extent permitted by law, Climber Code is not liable for indirect, incidental, or consequential damages, or for loss of profits, revenue, or data, arising from the use of our website or services.

Termination

Either party may terminate a project engagement in accordance with the terms set out in the relevant statement of work. Fees for work performed up to the point of termination remain payable.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Climber Code is registered, without regard to conflict-of-law principles, unless otherwise specified in a signed client agreement.

Changes to These Terms

We may update these Terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the revised Terms. The “Last updated” date below reflects the most recent revision.
